Q & A: CAN I USE ICE IN SHABBAT?

APPLICATION. Can I use ice to Shabbat? And freeze water to make ice cubes?

RESPONSE. If the ice melts or freezes the water (or other liquid) may incur, as appropriate, in a transgression.

The Gemara ( Shabbat 51b) says that it is forbidden to break the ice to get water.

According to Rashi the reason is that you are performing an action similar to a creative melakhah. Therefore, it is allowed to place the ice into a glass and use water as dissolved, as the ice melts on its own and is not the direct result of our action. This is the opinion of Maran Bet Yosef which is followed by the Sephardim.

According to the Sefer Ha-Truma it is a transgression of Nolad ("give birth, create a new entity"), regardless of our direct involvement. Accordingly, if you put the ice in a glass you are creating a new entity (water) and is therefore forbidden to do so. This is the view of Rema which is followed by the Ashkenazim.

makhloket This has practical ramifications. We see several cases

ice cubes in an empty glass. In the opinion of the Rema ( recovery from Shmirat Shabbat Ke-Ilchatà) a priori ( lechatchila ) are not allowed to put ice directly into a container and let it melt and then to use the ' water dissolved. In retrospect ( bediavad ), once created is allowed to use it, but it is better not to do it if more water is available. But if you need water and there is no other way to get their permission is a priori ( lechatchila ) melt ice cubes directly into an empty container ( Shmirat Ilchatà Shabbat Ke-10, 3, also see Rema 318, 16 and 320 , 9 and Mishna Bruria s'q '35).

The Sephardic know that, as we have seen, the Bet Yosef allowed to put ice in a priori an empty glass as the ice melts on its own and not by direct intervention of those who put in the glass ( Orakh Khaima 320, 9 and Mishna Bruria s'q '35).

ice cubes in drinks. Permission is granted to melt the ice cubes in a glass or a jug containing water or other drinks. For the Bet Yosef is not a problem since it is allowed to do so even if the glass is empty. Also according to the Rema is allowed because of the transgression Nolad occurs only if water dissolved becomes an entity unto itself, but in this case is indistinguishable from the melted ice drink.

is allowed to break a large piece of ice cubes to create, but you should not manually accelerate the dissolving of the ice in the drink, for example, pressing the ice ( Shmirat Ilchatà Shabbat Ke-10, 2).

The Sephardic Rabbi Ovadia Yosef to know that the second shlit'a (after review of the Bet Yosef seen above) is not only preferable, but it is forbidden to accelerate the dissolving process manually, because the action has and not the entity created ( Liviat Chen 58).

Cool fruit or juice in bottles. is allowed to melt the ice Shabbat and Yom Tov if the water is thrown so created. For example it is allowed to cool fruit or bottles containing putting the beverage in a container which is then placed in ice. Both according to the Bet Yosef the Rema the intention is not to use water that melts which is still thrown ( Shmirat Shabbat Ke-Ilchatà 10, 1).

freezing water. According to the Rema , since freezing water could fall into the category of Nolad is preferable not to put water in the freezer to make ice cubes, except that you can not do without during the day . is therefore preferable to make ice must first Shabbat ( Shmirat Ilchatà Shabbat Ke-10, 4).

The Sephardic Rabbi Ovadia Yosef to know that the second shlit'a allowed to put water in the freezer without having much needed since the ice cube is not formed by direct action ( Yechavè Da'at 1, 30).
